秋も深まり紅葉が美しいこの頃ですが、いかがお過ごしでいらっしゃいますか。
さて、今回は、EUのGMP及びGDPのノンコンプライアンスレポート（Non-Compliance Report）を取り上げたいと思います。
ウォーニングレターに比べて指摘の内容が詳しくないのですが、EUの規制当局がどんな点を指摘しているのか、参考にしてみていただければと思います。
１．EU GMPノンコンプライアンスレポート
EU GMPノンコンプライアンスレポートは、EUの当局による製薬会社の製造所の査察において、EU GMPに不適合と判断される問題が見つかった場合に発行されるもので、3部構成になっています。
Part1に確認した当局の名前、製造業者の名前、製造所の住所等、Part2にノンコンプライアントな製造オペレーション、Part3に不適合の内容、EUの対策等が書かれています。
査察結果を報告するという点ではウォーニングレターと似ていますが、前述の通り、ウォーニングレターに比べて、指摘の内容があまり詳しくありません。また、不適合を、クリティカル（Critical）、メジャー（Major）、その他（Others）に分類して、クリティカルとメジャーが何件あったかを明記しているという特徴があります。Part3の不適合の内容をみていきたいと思います。
■Report No.BE/NC/2022/02
ベルギーの当局が2022/5/19にトルコの製薬会社を査察し、2022/5/31付で以下のノンコンプライアンスレポートを発行した。
●ノンコンプライアンスの性質
クリティカルな欠陥：危険な製品の交叉汚染のリスク管理の不履行
●当局によりとられた／提案された行動
・GMP証明書の取り消し
現在有効なGMP証明書の制限
・既に出荷されたロットの回収
潜在的な品質不良と供給制限のアセスメントにより回収を検討
・供給禁止
EU市場に供給されるロットは他になし
■Report No.IT/NCR/API/1/2022
イタリアの当局が2022/5/27にイタリアの製薬会社を査察し、2022/10/26付で以下のノンコンプライアンスレポートを発行した。
●ノンコンプライアンスの性質
査察中、メジャー13件、その他1件の不備がみつかった。メジャーの不備は、不十分な医薬品品質システムと建物及び装置のメンテナンスに関するものだった。
具体的には、
１）査察中、許可されていない製造や装置の記録が見つかった。
製造施設内でみつかった記録は、GMP文書に記録されていないロットや装置の製造作業や装置の使用／メンテナンスに関する非GMP文書だった。
２）建物や装置のメンテナンス・使用・洗浄作業の欠陥
ほとんどの施設は汚れており、使用目的のために適切に設計されておらず、装置は適切に洗浄もメンテナンスもされていない。
その他に関連する調査結果は、原材料の管理、ユーティリティ、文書管理で見つかっている。
AIFA(イタリア医薬品庁)は会社の要請により、製造所を一時停止とした。市場からの回収は実施されていない。査察した会社で製造されている原薬を含む医薬品は重要で、医薬品の不足が真のリスクと考えられる。
●とられた／提案された行動
・現在有効なGMP証明書の取り消し
・要求された製造承認の変更
関連する各当局は、MAHと共同で医薬品の回収が必要か評価を実施する必要がある。
・供給禁止
評価には、代替の供給者がいるかと、医薬品の不足の潜在的なリスクを考慮する必要がある。
AIFAの査察時点で既にリリースされていたが、まだ出荷されておらず、会社から情報が提供され
ているロットのリテスト結果に基づき、査察した会社で製造された原薬を含む重要な医薬品の
不足の真のリスクを考慮し、販売を許可するだろう。
・その他
この会社は、新規/進行中の申請が承認されるべきでない。関連する各当局は、この会社が現在
の製造承認から削除する必要があるかどうか評価する必要がある。会社は、9月29日に、製造所
での製造作業の復活要求を提出した。AIFAの評価は進行中である。
■Report No.2022052722
デンマークの当局が2022/6/2にトルコの製薬会社を査察し、2022/9/2付で以下のノンコンプライアンスレポートを発行した。
●ノンコンプライアンスの性質
会社は、無菌状態で調製または最終的に滅菌された小容量の無菌医薬品を受託製造している。
会社は、1つのカプセルと国内またはDCP(Decentralized Procedure)/MRP(Mutual Recognition
Procedure)で許可されたその他の製品を含む多数の原薬と賦形剤を取り扱っている。
2022年5月30日から6月2日に実施されたオンサイトの査察で、メジャー7件を含む47件の指摘が
あった。
7件のメジャーのGMPの不備は、製品の品質と安全性にリスクをもたらす可能性があると考えられ、2022年6月17日に監督リスクアセスメントのドラフトとノンコンプライアンスレポートのドラフト
が発行された。それ以来、会社は、査察の指摘事項で挙げられた懸念に対処する機会を得た。
会社は、いくつかのメジャーの不備の今後のアプローチについて許容可能な回答を提出した。
しかし、EU GMPに準拠しない状態で製造され、現在EU/EEA市場にある製品に関していまだに大きな懸念が残っている。これらの懸念は、ノンコンプライアンスレポートを発行する必要があるレベルの懸念であり、市場に対応を起こさせる可能性がある。特に、多目的装置の洗浄プロセスの不十分な管理から生じる交叉汚染のリスクは、このノンコンプライアンスレポートの根拠となっている。
ノンコンプライアンスレポートの根拠となるその他の残りのリスクは、手作業の目視検査の不十分な管理と、継続的な工程の検証の不足から生じる不十分なプロセスバリデーションの管理である。
これらの不備は、使用されている充填技術(BFS(成形同時充填), PFS(プレフィルドシリンジ),バイアル、アンプル)）に関わらず、製造される全ての製品にあてはまる。メジャーの不備の詳細なリストは、監督リスクアセスメント内で見ることができる。
●とられた／提案された行動
・現在有効なGMP証明書の取り消し
・既にリリースされたロットの回収
品質不良の可能性と、製品の重要性及び供給制限の可能性に関する当局のアセスメントに従い、
会社が製造した医薬品の全てのロットの回収の検討が推奨される。
・供給禁止
品質不良の可能性と、製品の重要性及び供給制限の可能性に関する当局のアセスメントに従い、
会社が製造した医薬品のロットの更なる流通とクオリファイド・パーソンによる認証の停止の
検討が推奨される。
・その他
当局は、契約提供者と受託製造業者の間の契約上の責任が明確で、両当事者により遵守されている
ことを確実にするために、影響を受ける医薬品販売承認取得者／契約提供者と連絡をとることを
推奨している。
■Report No.IT/NCR/API/02/2022
イタリアの当局が2022/9/1にイタリアの製薬会社を査察し、2022/10/7付で以下のノンコンプライアンスレポートを発行した。
●ノンコンプライアンスの性質
製造されたほとんど全ての原薬は、社内で注射剤を製造するのに使用されていたが、登録ファイル/販売承認は、どの医薬品販売承認取得者からも提出されていなかった。
以下の懸念が生じる：HVACシステムの欠如による、ウイルス不活性化活動の前と後の交叉汚染のリスク。さらに、同じ装置が、ウイルス不活性化活動前後のステップで仕様されていた。
ウイルス不活性化活動前の汚染管理の不備：一部の作業は、密閉システム内で実施されていなかった。洗浄活動の管理の不備：不活性化剤(NaOH 1M)の接触時間は、装置の接触部品についてバリデートされていなかった。不活性化活動の前後、仕上げ段階で使用された装置の洗浄や、洗浄された装置の保管で使用できる洗浄室は1つだけだった。
供給者のバリデーション管理の不備：供給者は監査されたことがなかった。有効成分の製造に関するリスク評価のための、ウイルスの安全性に関すリスクアセスメントは実施されなかった。最終的な不定の化学物質を特定するための分析試験は業務用ロットでは行われず、試験室での試験のみが実施された。2021年9月21日に、製造許可が停止された。
●とられた／提案された行動
・現在有効なGMP証明書の取り消し
・既にリリースされたロットの回収
原薬は医薬品製造用に出荷されていなかった。原薬は、社内で注射剤を製造するために使用された。

EU GDPノンコンプライアンスレポートは、EUの当局による医薬品卸売販売業者の査察において、EU GDPに不適合と判断される不備がみつかった場合に発行されるもので、3部構成になっています。Part1に確認した当局の名前、卸売販売業者の名前、卸売販売業者の住所等、Part2にノンコンプライアントな作業、Part3に不備の内容、当局の対策等が書かれています。
Part3の不備の内容をみていきたいと思います。
■Report No.2022_NCS_001
フランスの当局が2022/1/6にフランスの卸売販売業者を査察し、2022/6/16付で以下のノンコンプライアンスレポートを発行した。
●１．ノンコンプライアンスの性質
欠陥のある品質システム、安全対策が実施されておらず、コールドチェイン製品の管理されていない保管条件(温度)、シリアルナンバリングの不履行
●２．当局によりとられた/提案されたアクション
卸売販売業許可の差し止め
■Report No.24.05.17-07-0030
ドイツの当局が2022/1/12にドイツの卸売販売業者を査察し、2022/1/18付で以下のノンコンプライアンスレポートを発行した。
●１．ノンコンプライアンスの性質
必要とされる専門知識を持った責任者の不在
-卸売販売業者が、法令で規定された適切な業務が遵守されていることを保証することができない
-供給者と顧客の適格性評価がない
-卸売販売許可に含まれない医薬品の取引
●２．当局によりとられた/提案されたアクション
-卸売販売業許可の差し止め
●３．追加コメント
-顧客はドイツのみに存在する

ドイツの当局が2022/5/2にドイツの卸売販売業者を査察し、2022/6/1付で以下のノンコンプライアンスレポートを発行した。

アイルランドの当局が2022/10/11にアイルランドの卸売販売業者を査察し、2022/11/2付で以下のノンコンプライアンスレポートを発行した。
●１．ノンコンプライアンスの性質
これに限定されないが、会社は、サプライチェインの完全性と、供給された医薬品の安全性を保証するために、医薬品の調達、保持、供給に関し、以下のことを含む、適切な管理を証明することを怠った。
・許可されていない施設での医薬品の保管
・責任者が卸売販売業者の管理のもとで発生する活動の管理と、GDPの記録の正確性や品質を証明
することを怠った。
・許可されていない施設での調達及び供給活動の実施
・卸売販売業者の敷地で、卸売販売業者の管理のもとで実施された卸売販売活動に関連する記録が
ない。
・現場で品質マネジメントシステムが維持されいない、もしくは、使用されていない。
・卸売販売業者の施設が厳重に警備されておらず、医薬品が保管されているエリアは目的に適して
いない。
●２．当局によりとられた/提案されたアクション
卸売販売業許可の即時差し止め
●３．追加コメント

まとめ

GDPノンコンプライアンスレポートの1件目（Report No.2022_NCS_001）に、シリアルナンバリングの不履行の指摘が含まれていました。
シリアルナンバリングは、偽造医薬品対策の一貫として2019年2月を期限にEUが導入した、医薬品のパッケージに製品コード、シリアル番号、ロット番号、有効期限を印字する制度で、日本からEUに輸出する際にも適用されるのですが、現時点で徹底されていないケースがあるようで興味深いです。
