今回は、FDAがアメリカ国内の製薬会社向けに出したウォーニングレター２件を取り上げ、FDAがどのような点を指摘したかを確認していきたいと思います。

2021年5月3日～5月19日にミズーリ州の契約試験研究所を査察してみつかつた医薬品と原薬製造の重大なCGMP違反について発した2021年9月30日付ウォーニングレターには、下記の指摘事項があげられています。
■最終製品の違反

貴社は、そのロットが既に出荷されたかどうかに関わらず、ロットや成分の規格との説明のつかない不一致や規格外（OOS）の結果を徹底的に調査することを怠った。

貴社は説明のつかない不一致や規格外（OOS）の結果を徹底的に調査することを怠った。更に、調査は、適切な科学的に正当な理由もなく打ち切られた。例えば、
- 製品XXのロットXXはXXに分析試験で不合格になった。もともとの製剤のサンプルの再試験も 不合格の結果になった。貴社の研究所の調査は、不合格の根本原因を特定しなかった。貴社は、科学的に正当な根本原因もなしに、もともとのOOSの結果を無効化するために、再サンプル・再試験を信頼した。
- 貴社は、XXの記録の改竄を検知し、徹底的に調査することを怠った。実際のサイクルがXXの場合、XXの期間中、XXがログブックに故意に記録された。
貴社は回答の中で、最新のOOSの調査報告を提出し、OOSの不具合は、最初の調査の結果に矛盾する、不適切なサンプルといった、よく知られた試験のエラーによるものだったと述べた。
貴社の回答は不適切である。貴社には、OOSの結果の根本原因として試験のエラーという修正された貴社の結論を裏付ける証拠が不足していた。
さらに貴社は、その期間中に生成されたXXの記録をレビュするための調査を最近開始したと述べた。
貴社の回答は不適切である。貴社の調査は、加圧滅菌器の記録の改竄や、試験中に発生したデータ・インテグリティの他の違反の範囲の包括的なアセスメントが不足していた。

貴社は、権限を与えられた職員のみが製造指図書原本またはその他の記録の変更を行うことを保証するために、コンピュータまたは関連するシステムの適切な管理を実施することを怠った。

貴社はXXのシステムに関する適切なセキュリティとアクセス管理をしなかった。例えば、XXのソフトウエアと、ウインドウズのオペレーティングシステムのために、固有のユーザアカウントと権限レベルが個々のユーザに割り当てられていなかった。分析者たちは、データを削除し上書きする権限を持っていた。
我々査察官は、ゴミ箱内に36の削除されたファイルまたはフォルダを発見した。
さらに、貴社の分析者たちは、さまざまな医薬品の分析、不純物、含量均一性、溶解試験の計算のために、個人的なバリデートされていなXXのスプレッドシートを使用した。
貴社は回答の中で、XXシステムをアップブレードすることを計画していると述べた。しかし、貴社は、データやファイルの削除や変更の発生や再発を防ぐための暫定的な管理に関するCAPAの計画を提出しなかった。また、貴社は、“デスクトップ上の削除されたファイルは、オリジナルのデータファイルを編集用にコピーしたものであった。オリジナルのデータファイルはまだデータベースにあった。”と述べた。
貴社の回答は不適切である。貴社は、影響の可能性を評価するための回顧的なレビュを実施せず、データ・インテグリティを保証しなかった。

貴社は、XXに関し、未確認の試験のエラーのせいにした最初のOOSのXXの結果を得た。貴社はXXの新しいサンプルで分析をくりかえし、4つのサンプルで再びOOSの結果を得た。その後、XX人の分析者により、新しいサンプルで、貴社の顧客のプロトコルに従って分析を繰り返し、規格値内の結果を得た。貴社は、科学的に正当な根本原因もなしに、もともとのOOSの結果を無効化するために、再サンプル・再試験を信頼した。
貴社は回答の中で、改訂されたOOSの調査報告を提出し、OOSの不具合は、最初の調査の結果に矛盾する、不適切なサンプルのようなよく知られた試験のエラーによるものだったと述べた。

貴社の品質システムは、貴社がテストした薬の安全性、効果、品質を裏付けるデータの正確性・完全性を適切に保証していない。CGMPに従ったデータ・インテグリティの手順を制定して遵守するためのガイダンスとして、FDAのガイダンス文書Data Integrity and Compliance With Drug CGMPを見よ。
我々は、貴社が貴社の作業を監査し、FDAの要求を満たすことを助けるコンサルタントを雇っていることを認識している。この文書への回答の中で、以下の情報を提供せよ：
Ａ．データの記録と報告の不正確性の範囲の包括的な調査

Ｃ．全体的な是正処置及び予防処置の計画の詳細を含む貴社の管理の戦略
貴社の戦略には下記のことを含めよ：
- 分析データ、FDAに提出した全てのデータを含む貴社が生成した全てのデータの信頼性と網羅性を保証するために貴社がどのようにするつもりかを述べた詳細な是正処置計画
- 現在のアクションプランの範囲と深さが、調査とリスクアセスメントで見つかったことに釣り合うことを示すエビデンスを含んだ、データ・インテグリティの欠落の根本原因の包括的な記述

■品質部門の権限

■契約試験研究所の責任
FDAは、受託業者を製造業者自身の製造所の延長とみなす。貴社のCGMPの不順守は、貴社の顧客のために貴社が試験した医薬品の品質、安全性、効果に影響を与える可能性がある。CGMPを完全に順守して作業をする責任を理解し、これらの医薬品の試験中に遭遇したOOSの結果や重大な問題を全ての顧客に通知することが重要である。更なる情報については、

●結論
この文書で挙げた違反や逸脱は、貴社の施設に存在する違反や逸脱の包括的なリストでもない。
貴社には、違反や逸脱を調査し、原因を判断し、再発やその他の違反や逸脱の発生を防止する責任がある。
全ての違反や逸脱を速やかに是正せよ。この問題への即座の適切な対処の不履行は、制限のない差し押さえ、強制命令を含む、さらなる通知のない制限または法的なアクションにつながるかもしれない。未解決の違反は、他の連邦機関の契約授与も妨げるかもしれない。
違反や逸脱への対処の不履行は、FDAの輸出証明の発行の差し控えにもつながるかもしれない。

2021年5月25日～6月3日のカリフォルニア州の製造所の査察でみつかった医薬品製造の重大なCGMP違反について発した2021年11月29日付ウォーニングレターには、下記の指摘事項があげられています。

貴社の品質管理部門は、製造された医薬品がCGMPに従っていることと、同一性、濃度、品質、純度に関して制定された規格を満たすことを保証する責任を果たさなかった。
＜指摘１詳細＞
＊不適切な調査/工程管理の不足
貴社は塩化ベンザルコニウムを含む手の除菌用ローションを含むOTC医薬品の製造を受託している。手の除菌用ローションの複数のロットは、数えきれない微生物の結果（Too Numerous to Count: TNTC）により、総プレート数(Total Plate Count : TPC)の試験で不合格になった。貴社の品質部門(QU)は、手の除菌用ローション内の微生物汚染を適切に調査して根本原因を特定することを怠った徹底的な調査の実施と是正処置・予防処置を実施するかわりに、貴社のQUは：
- 最初に微生物のTPC試験で不合格になったロットに抗菌性保存剤を加えることを承認し、貴社の顧客による販売のためにリリースした。
- 合格の結果が出るように、まだ微生物のTPC試験を実施していないロットに抗菌性保存剤を加えることを承認し、貴社の顧客による販売のためにリリースした。
さらに、手の除菌用ローション(保存剤を加えていない既にリリースした製品)のロットの安定性サンプルは、TNTCの結果により、微生物のTPCに関して3ヶ月の安定性試験で不合格になった。
貴社は、顧客に通知し、自発的な製品の回収を勧めたと述べた。貴社の顧客は、それを断り、ロットは売られ消費されたと貴社に知らせた。更なるアクションはとられなかった。
貴社は回答の中で、貴社のコンサルタントとマネジメントレビュを実施し、貴社の手順は十分に安定しておらず、詳細でないという判断をしたと述べた。貴社は、微生物の不具合の詳細な調査結果を提出しなかったので、貴社の回答は一部が不適切である。また貴社は、コンサルタントのレビュや是正処置の詳細を提出しなかった。さらに、貴社のQUは、根本原因の判断と適切は是正処置の戦略を含む、今後の調査を徹底的にすることを保証するための職務と監督を実施しなかった。
この文書への回答の中で、以下の情報を提供せよ：
- 貴社の逸脱、不一致、苦情、規格外の結果、不具合の調査をするための全てのシステムの包括的で独立したアセスメント

＊適切なレビュ前の医薬品の出荷承認
貴社のQUは、完全な最終製品試験をせずに、医薬品の出荷承認をした。例えば貴社は、2020年6月1日に手の除菌用ローションのロットXXを出荷した。しかし、分析結果は、2020年6月3日以後に利用可能になり、微生物試験の結果は2020年6月8日に得られた。貴社のQUは微生物試験結果を受け取る前で、ロットが顧客に出荷された後の2020年6月3日に分析証明書を承認した。
貴社は回答の中で、貴社は、製品は貴社のQUにより承認されリリースされるまで州際通商で販売されないという口頭の取り決めのもとで、リリースされていない製品を移動すると述べた。この業務は受け入れられないし、品質特性を満たさない医薬品が顧客に出荷されるリスクを高める。
貴社が製造した医薬品が適切な規格を満たしているかどうかを判断するために、リリース前に医薬品の各ロットの試験を完了することが必要とされている。
この文書への回答の中で、不合格でない製品が出荷されたことを所掌するために、貴社が製造した全ての手の除菌用製品の独立した回顧的なレビュを提出せよ。もしレビュで品質基準を満たさない医薬品が出荷されたことが明らかになった場合、顧客への通知や製品の回収といった迅速な是正処置をとれ。
＊不十分な安定性プログラム
貴社のQUには、貴社の安定性プログラムの適切な品質の監視が不足していた。例えば貴社は、貴社のPackage Compatibility Test Programの手順に従うことを怠り、貴社のヒドロキノン医薬品XXの製品と工程を示すために、安定性試験XXに各製品のXXをセットすることを怠った。
貴社は回答の中で、貴社のヒドロキノン医薬品XXに使用する製剤は、異なる製品XXの中に包装され、それらの製品の全ては、最初に安定性プログラムにセットされていると述べた。
さらに貴社は、製剤、包装サイズ、構造材は製品XXと同じなので、貴社はXXの安定性試験の実施にはブラケット法(※両極端の検体の安定性により、中間の検体の安定性も示されるという方法)を使用していると言及した。
しかし、貴社の回答は、異なる容器密閉システムのデザインを示していた。したがって、ブラケット法は科学的に正当であるように見えない。さらに、これらの製品に関する安定性プログラムに対するブラケット法のアプローチに対する変更は、適切な変更管理をせずに実施されていた。
この文書への回答の中で、以下の情報を提供せよ：
- 貴社の安定性プログラムの適格性を保証するための、包括的で独立したアセスメントとCAPAの計画
貴社の改善されたプログラムは、これに限定されないが以下のことを含むべきである：- 出荷が許可される前に市販されている各医薬品の容器／施栓系内の安定性の研究
- 安定性を示す方法
- 宣伝されている使用期限が妥当かどうかを判断するために各製品の代表的なロットが毎年プログラムに追加されるような継続的な安定性プログラム

- 貴社の改善された安定性プログラムについて述べた全ての手順
- 全ての医薬品についての、正当な理由を添えた使用期限のリスト(例：リアルタイムの3年の安定性データ)
＊不適切な文書の品質の監督
貴社のヒドロキノン医薬品XXロットXXのバッチレコードのレビュ中、我々査察官は、製造活動が同時に記録されていないことに気付いた。例えば、1人の職員が、容器の測定や、別の日にバルクの照合などの複数の製造手順を実施したというバッチレコードを記録し、第二の職員がそれらの活動の確認を記録した。しかし、第二の職員（確認者）は、我々査察官に、これらの手順が実施された記録された時に、彼らは仕事をしていないと述べた。貴社のQUは、製造記録が正確で、製造が記録された通りに実施されたという適切な保証をしていない。
貴社は回答の中で、適切な文書管理手順が守られていなかったことを認めた。また貴社は全職員の教育を実施したとも述べた。貴社の回答は不十分である。貴社の品質システムは、貴社が製造する医薬品の安全性、効果、品質を裏付けるためのデータの正確性・完全性を適切に保証していなかった。正確な記録がなければ、貴社は、継続的な品質の保証に必須であるロットのリリース、製品の安定性、その他の事の適切な判断を保証することができない。
この文書への回答の中で、文書化の手順が不十分である場所を判断するために、貴社の製造及び試験の作業で使用されている文書システムの完全なアセスメントの情報を提出せよ。アセスメントには、貴社の作業を通じて、帰属可能で、判読可能で、完全で、原本であり、正確で、同時性のある記録を保持していることを保証するための文書化手順を包括的に改善する詳細なCAPAの計画を含めよ。
上の例は、貴社のQUがその役割と責任を果たすにあたっての基本的な不備を示しているが、工程管理の監督、調査の対応、ロットのレビュと処理の判断、データの適切な管理に限定されるものではない。

また、これに限定されないが、製造/品質の新たに発生した問題に積極的に対応し、継続的な管理状態を保証するためのタイムリーなリソースの提供をするために、貴社の経営陣が、いかに品質保証と信頼できる作業をサポートするかについて述べよ。
2021年9月20日、FDAは、貴社と貴社のコンサルタントと一緒にテレビ会議を実施した。我々は、この文書で言及した状態で製造された使用期限内の全ての手の除菌用医薬品の廃止を検討することを勧めた。2021年9月21日、貴社は手の除菌用医薬品の特定のロットを自発的に回収した。
2021年9月22日、FDAは貴社の微生物汚染を防止する適切な管理の欠如について公表した。
CGMPの規制21 CFR parts210,211の要件を満たすための品質システムとリスクマネジメントアプローチの実装の助けとして、
FDAのガイダンス文書Quality Systems Approach to Pharmaceutical CGMP Regulationsを見よ。

貴社は、成分、製品の容器、蓋、中間材料、ラベル、医薬品が同一性、濃度、品質、純度の適切な標準に従うことを保証するために設計された、科学的に妥当で適切な規格、標準、サンプリング計画、テスト手順を含む試験の管理を制定することを怠った。
＜指摘２詳細＞
貴社は、多数の再加工したロットと、製品の処方に追加された保存料の抗菌有効性の試験を示すことなく新たに再処方化したロットをリリースし、販売した。特に、貴社の手の除菌用医薬品は、TNTCの結果によりバルク段階のリリース試験中に微生物のTPCに関して不合格になっていた。貴社は、抗菌保存料を追加することでこのロットを再加工した。貴社の逸脱報告では、保存料はベンザルコニウムの分析結果に影響を与えないように微生物の安定性を追加したと述べていた。
貴社の回答は不十分である。貴社は契約試験機関から得た完全な試験データを提出しなかった。
アメリカ薬局方<51>の通り、抗菌保存料は、GMPのための代用品として使われたり、非殺菌医薬品の生存している微生物数を減らすだけに使用されたりすべきではない。
