厚生労働省は『製造販売業者及び製造業者の法令遵守に関するガイドライン（案）』（以下、「ガイドライン案」）に関するパブリックコメントの募集を8/11から開始した。
本ガイドライン案は医薬品等の許可等事業者のうち、製造販売業者および製造業者が法令遵守体制を構築するための取り組みを検討し、実施するための指針を示すものだ。
本ガイドライン案は大きく分けて主に2つの事項について述べている。
- 薬機法令体制の構築
- 責任役員や総括製造販売責任者等の役職者の権限の明確化、権限の付与、申述された意見の尊重、改善措置の実施
特に、総括の権限の明確化、権限の付与、意見の尊重が大きいと思われる。
これまでは、ともすると総括は名ばかりで、存在そのものの意義が問われかねなかったためであると筆者は考えている。
1.薬機法令遵守のための体制の構築
- 社内規程の作成
- 役職員等への教育
- 業務記録の作成
- 役職員の業務遂行状況の管理監督のための仕組みの構築
ここにおいて役職員とは、役員および従業員を指しており、従業員のみならず経営者にも適切な教育を行う必要性を謳っている。
2. 責任役員や総括製造販売責任者等の役職者の権限の明確化、権限の付与、申述された意見の尊重、改善措置の実施
- 薬機法令の遵守に責任を負う役員や総括製造販売責任者等の薬機法令が求める責任者を選任すること
- 当該役職者の権限および範囲を明確化すること、必要な権限を付与すること
- 当該役職者から申述される意見を尊重し、必要に応じて改善措置を講じること
改正薬機法について
改正薬機法では、薬機法による法規制を受ける業者に対して以下を求めている。
１． 法令遵守体制の構築
２． 薬事に関する業務に責任を有する役員（以下、責任役員）の選任
３． 技術責任者の選任
４． 技術責任者の意見の尊重および必要な措置を講じること
ここにおいて、法規制を受ける業者とは、医薬品等（医薬品、医薬部外品、化粧品、医療機器、再生医療等製品）を、許可を受けて製造販売・製造・輸入・販売等を行う者のことを指す。
製造販売業者等が今後実施すべき事項
ガイドライン案では、改正法遵守のための取り組みとして実施すべき事項を示している。
1. 薬機法令遵守のための体制の構築
製造販売業者等の業務の遂行が法令に適合することを確保するための体制を整備するための実施事項として以下が示されている：
a. 法令遵守体制の基礎の構築
法令遵守体制の基礎としてすべての役職員に法令遵守規範を根付かせるべく、以下を実施すること：
- 法令遵守のための指針を従業員に対して示すこと
- 各責任役員の権限や責任範囲を明確にすること
b. 役職員が遵守すべき規範の策定
製造販売業者等の役職員が遵守すべき規範を、社内規程において明確に定める必要がある。
当該規程には以下を含み、明確化する必要がある：
《意思決定の仕組み》
- 意思決定を行う権限を有する者および当該権限の範囲
- 意思決定に必要な判断基準
- 意思決定に至る社内手続き
等
《意思決定に従い各役職員が適正に業務を遂行するための仕組み》
- 指揮命令権限を有する者
- 当該権限の範囲および指揮命令の方法
- 業務の手順
等
c. 役職員に対する教育訓練および評価
b.で策定した社内規程の内容を役職員に周知し、その遵守を徹底する必要がある。
その方法として以下が示されている：
- 役職員に対して計画的・継続的な教育訓練等を実施する
- 法令等や社内規程の内容や適用等について役職員が相談できる部署・窓口を設置する
- 役職員による法令等や社内規程の理解やその遵守状況を確認・評価する
d. 業務記録の作成、管理および保存
業務内容を適時に正確に記録する体制を整える必要がある。
その方法として以下が示されている：
- 業務記録の作成、管理および保存の方法などの文書管理に関する社内規程を定めること
- 事後的に記録の改変ができないシステムにすること

e. 役職員の業務の監督に係る体制の構築
役職員が法令を遵守し、適切に意思決定および業務遂行をすることをモニタリングし、必要に応じて責任役員に報告したり、必要な改善措置を講じることができる体制を構築するための方策として、以下が示されている：
- 内部監査の実施および発見した問題等の責任役員への報告
- 実効性のある内部通報制度の構築
- 監査役等による監査の実効性の確保
- 総括製造販売責任者等による業務の監督や、意見の具申が適切に行われる体制の構築
f. その他の体制
上記以外に、法令遵守体制の構築を目的として以下が示されている：
コンプライアンス担当責任役員の指名
各部署にコンプライアンス担当者を設置
2. 責任役員や総括製造販売責任者等の役職者の権限の明確化、権限の付与、申述された意見の尊重、改善措置の実施
改正薬機法では薬事に関する業務に責任を有する役員の選任が求められている。
責任役員は株式会社の場合は会社を代表する取締役および薬事に関する法令に関する業務を担当する取締役がそれにあたる。
製造販売業者等は責任役員の権限および分掌する業務を明らかにする必要がある。
また、責任役員は以下の責務を負っている：
- 法令遵守体制の構築および運用を行う
- 法令違反について責任を負う
また、本ガイドライン案では、総括製造販売責任者等に関して、以下の事項が求められている：
- 製造販売業者における総括製造販売責任者が有する権限を明らかにすること
- 製造業者における製造管理者または責任技術者の有する権限を明らかにすること
- 総括製造販売責任者およびその他の責任者が適正に業務を遂行できるよう必要な権限を付与すること
- 総括製造販売責任者の選任にあたっては、権限に係る業務を行うことができる知識、経験、理解力、及び判断力を有することを客観的に判断すること。また、責任役員に対して忌憚なく意見を述べることができる職務上の位置づけを有するかどうかについても十分に考慮すること
- 総括製造販売責任者が認識した問題点について、製造販売業者等に対して書面によって（緊急の場合は除く）意見申述を行うこと
- 総括製造販売責任者およびその他の責任者が付与された権限を適正に行使し、業務を遂行していることを監督し、必要に応じて改善措置を講じること
その他、今般の薬機法改正の際に検討がなされた過去の薬機法令違反を踏まえ、以下が求められている：
- 承認書の内容と齟齬する医薬品等の製造販売が行われないための措置を講じること
- 副作用等報告が適正に行われるための措置を講じること
- 医薬品等に関する適正な情報提供が行われるための措置を講じること
